A judge has been listening to arguments in a court case that could stop people across the United States from getting a specific type of abortion treatment. The case is backed by a group of religious people who are against the drug used for abortions called mifepristone.

A combination of two pills called mifepristone is a very popular way to get an abortion in the U.S. The ruling about this type of abortion will affect both states that allow it and those that don’t. Some people are worried that courts are being less clear and there might be some “judge shopping”. This means a lot of talk about how medication abortions works, what happens if this kind of abortion challenge succeeds, and there is even an argument about not promoting abortions in order for people to access it.

A lawsuit was filed in Amarillo, Texas and was appointed to Judge Matthew Kacsmaryk who used to be a lawyer at a Christian law firm. He wrote something that wasn’t too favorable about Roe in the past. President Donald Trump appointed him but Democrats were not happy about it.

“Mifepristone Availability On The Line

Medication is the most popular method of abortion in America today. The Guttmacher Institute, which is an organization that supports having a right to choose, made it even easier by allowing people to get medication online and have it sent through the mail. When laws were passed making abortion illegal, many women needed to travel long distances just to have access or looked for ways to get medication online.

If Kacsmaryk decides to make mifepristone unavailable, it would be a problem for all of the United States. This would be unlike anything that the FDA has seen before because they decided in 2000 that using mifepristone along with a second pill, misoprostol, is an okay and safe way to terminate a pregnancy.

A group of 22 states, which are led by Democrats, said in legal documents that not allowing people to get abortion pills through the mail would be really bad. Another group of 22 states, led by Republicans, agree with the reversals and think it will stop people from accessing abortion.

Judge Shopping in Texas

Judge Kacsmaryk is someone who works for the United States court system. The main job of this court system is to decide if laws and policies are allowed according to the Constitution. It means that any judge looking at a case involving a federal law or policy could make a decision that affects everyone in America.

In a case, both sides can disagree with the initial decision and ask for it to be changed. To do this, they can ask the 5th Circuit Court of Appeals, who usually make decisions that agree with conservative ideas. In an important case, the court made a ruling agreeing with Kacsmaryk’s opinion to keep an immigration policy created by Donald Trump in place. However, eventually the Supreme Court said no and overturned the lower court’s ruling.

People are worried about something called judge shopping. That’s when people try to get their cases heard in front of a judge who may agree with what they want. This has happened in Texas, and it happens for all kinds of groups with different opinions. But the experts are concerned because so many cases have been filed before certain judges there.

Judge Kacsmaryk Changes Plans

Judge Kacsmaryk had a conference call with attorneys, and he asked them not to tell anyone else about what they were going to discuss. He was setting up the first hearing for the case that lots of people are keeping an eye on.

He said he wanted to wait and not tell anyone about the hearing until very close to the date, which was bad because Amarillo is far away from larger cities. That kind of waiting so long before announcing it is really unusual in American courts and people usually hear about it weeks or months early.

But then, after stories were published in the news, they decided to post information about the hearing a day and a half sooner than they planned.

Ruling on FDA Appeal Looms; Doctors Prepare for Potential Changes

The judge for the case can make a decision any day now, once all of the arguments have been heard. If the FDA loses this case, it is likely that the government will try to appeal it straight away.

It’s not common for a ruling to change what it allowed before, so nobody knows what will happen. If using both drugs in the two-drug combination is no longer ok, doctors can use only one of the drugs instead. This isn’t quite as good but it could work.
